Question by Nancy:
Does family have rights to private land once a family member is buried there?
Our family is probating a will and the property is going to be up for sale. One family member wants to buy the property but the lawyer says this may be a dispute between family members and would rather sale to outside buyers. What rights does the family have in keeping the property within the family?

You write the restrictions in the deed when the property is sold. You include rights of way and maintenance agreements if any are needed. There are some private cemetary CCR's that pertain to specific situations and counties; the real estate lawyer drawing up the deed will know.,\\
Property is sold subject to the rights you create. There is nothing I've ever seen that would stop a property from being sold because someone was buried there.
